Who makes Atwater
Atwater is made by Try-Catch (try-catch.co), “we” in these terms.
Who Atwater is for
Atwater is for people 18 and over. When you sign up it asks when you were born, and an account for someone younger is deleted, with what was entered for it. Your account is for you alone: keep your sign-in to yourself.
What the numbers are
Atwater's numbers (calories, nutrients, goals, the day's score and the coach's advice) are estimates, many of them made by AI from a photo or a few words, for your own tracking. They aren't medical advice and can be wrong, which is why every one is yours to check and correct. Talk to a doctor or dietitian before you change how you eat, above all if you're pregnant, have a health condition or have had an eating disorder.
What you put in
What you put in stays yours: Atwater doesn't own it. You give Atwater a lasting, worldwide, free license to keep, copy, change and use what you log and send (meals and their photos, foods, corrections and chats) to run the app for you. If you say yes to “Help make Atwater better?” (asked when you sign up, and changed in Settings), the license also covers improving Atwater and building new features and products, training AI models included, and sharing or licensing what you put in with others once your name, email and anything else that says who you are have been taken out. Saying no later, or deleting something or your account, stops that from then on, but doesn't undo what was already made from it, such as a trained model. Health data from your phone is never used this way: the privacy page says what it's for. When you correct a food's numbers and other people save the same numbers for it, Atwater can add them to its own food data, with nothing that says who you are.
Don't put in anything that isn't yours to share, use Atwater to break the law, try to get at anyone else's data, or run it with scripts in a way that keeps others from using it.
Copyright
If you believe something in Atwater infringes your copyright, email copyright@atwater.app with what the Digital Millennium Copyright Act asks for: your contact details, the work you own, where the material is in Atwater, a statement that you believe in good faith its use isn't authorized, a statement that what you send is accurate and, under penalty of perjury, that you own the right or act for whoever does, and your signature.
We take down material named in a valid notice and tell whoever put it in, who can send a counter-notice if they believe it was taken down by mistake. We close the accounts of people who infringe again and again.
Closing an account
You can stop using Atwater at any time, and delete your account and everything in it from Profile, Settings, Delete account (the privacy page says what goes), or by emailing privacy@atwater.app from the address you sign in with. We can close an account that breaks these terms.
Changes
Atwater is offered as it is: we work to keep it running and its numbers right, but can't promise either always will be. When these terms change, this page says so, with the date at the top.
